Disability Planning typically involves planning for a disabled beneficiary who is receiving governmental benefits. The concern is always the same: provide for the disabled beneficiaries without causing them to be disqualified from the benefits they are receiving. The solution is to use a Supplemental Needs Trust (SNT). An SNT can be drafted as a stand-alone trust that is created now or one that is created at death. Either way, the assets held in the Supplemental Needs Trust are not “countable” assets of the beneficiary and, properly drafted, will not cause disqualification.
